<li>This week Mattamy is starting renovation and repair work on the heritage buildings, including the smaller stone cottage so that it can be used as a &#8220;country style&#8221; small house. The scope of work includes raking out and repointing of mortar and reconsolidating deteriorated portions of the façade. They will be temporarily removing the wood porch structure to access the stones behind it. The City has issued a permit for this work.</li>
<li>Over the past three weeks, Councillor Glen has been meeting with the City Forester and City planning staff to review options for remediating the loss of the three trees that Mattamy removed without permission. After several iterations from Mattamy, the City Forester has accepted a new landscaping plan with significantly more trees being planted than before, and enhanced landscaping along on the north edge buffer.</li>
<li>We shared these plans with the community at a meeting on Monday, April 4 for feedback and questions. The City Forester is doing a final review and is planning to give approval for tree removal work to continue on Monday, April 11. (The landscaping and tree replacement plans are included below.) New trees and additional landscaping elements will be planted when the new homes are constructed. City staff will also be working with Mattamy to review and refine final landscaping plans over the coming months</li>

<p><strong>Councillor Glen&#8217;s comments:</strong><br />
&#8220;This is a situation where there really is no &#8220;win&#8221;. There&#8217;s no way to fully compensate for the trees that were lost. I did ask staff about pursuing the option to issue a fine to Mattamy, but based on advice from legal staff there is very little chance the City would be successful in winning a case. Even if we were successful, the amount of the fine would be small and would not directly benefit the Fairwinds community. The new landscaping plan from Mattamy is worth more than a potential fine, and will mean substantially more tree canopy. On balance, it&#8217;s a reasonable – if imperfect – way to compensate for the lost trees.</p>
<p>I’m never happy to see the loss of trees and forests in our community and I wish that we could save more of these natural areas. There will always be trees planted in new communities, but that doesn’t fully compensate for the loss of mature trees. It’s a loss that we can’t get back. Developers must follow the rules and have the proper permits when it comes to removing trees, and the City’s <a href="https://ottawa.ca/en/living-ottawa/environment-conservation-and-climate/trees-and-urban-forests/tree-protection-law">new Tree Protection By-law</a> that came into effect last year is helping, but there is still a long way to go, and in most cases provincial policy prioritizes home construction over retention of trees. I&#8217;ve shared some additional ideas about what we should be doing to protect the tree canopy in our neighbourhoods here: <a href="http://glengower.ca/notebook/notebook-saving-trees-from-development/">http://glengower.ca/notebook/notebook-saving-trees-from-development/</a></p>

<p><strong>UPDATE (March 14):</strong> Tree removal on the site started on Friday, March 11, 2022. After been alerted by area residents that some trees were improperly removed, I visited the site and asked the tree clearing company to cease work, and notified City staff. After conversations with the land owner and tree clearing company, the City Forester advised Mattamy to halt all tree removal work until further notice.</p>
<p>The landowner has advised that they failed to update the Tree Conservation Report after completion of the detailed grading analysis and has provided a rationale as to why the three trees in question were removed. City staff are meeting internally this week to review options which may include charges under the Tree By-law, various forms of compensation related to the trees that were lost and in consideration of the procedural missteps on the part of the landowner.</p>
<p>This matter will take time to resolve, but until it is resolved, no further tree clearing will take place.</p>

<p><span data-contrast="auto">Construction is beginning soon on a development at <a href="http://glengower.ca/development/1837-1849-maple-grove/">1837 and 1849 Maple Grove Road,</a> where Mattamy Homes is building 90 new homes. The two heritage structures on the site—a stone cottage and the Patrick Hartin House—will be retained and incorporated into the new development.</span> <span data-contrast="auto">Our office, in coordination with Mattamy, hosted a virtual public pre-construction meeting on </span><b><span data-contrast="auto">Tuesday, March 8, 2022  </span></b><span data-contrast="auto">via Zoom</span><b><span data-contrast="auto">. </span></b></p>

<li>Working hours: Most work will occur on weekdays, as per <a href="https://ottawa.ca/en/3-1-1/report-or-request/noise">Ottawa&#8217;s Noise By-law</a>.</li>
<li>Street sweeping: Will occur on a regular basis to mitigate dust and debris from the site.</li>
<li>Parking plan: As much as possible contractors and employees will be parking on-site. The land is quite large and there is existing parking available near the old stone house.</li>
<li>Tree removal: The landscaping plan calls for removal of most trees on the property. This is anticipated to begin starting in mid-March. Mattamy must acquire a tree permit from the City of Ottawa and follow all applicable by-laws.</li>

<h2>Récapitulatif : Séance d’information préalable aux travaux d’aménagement réalisés aux 1837 et 1849, chemin Maple Grove</h2>
<p><strong>MISE à JOUR du 14 mars :</strong> L’enlèvement des arbres sur le site a commencé le vendredi 11 mars 2022. Après avoir été averti par des résidents du quartier que certains arbres avaient été enlevés de manière inappropriée, je me suis rendu sur place et j’ai demandé à l’entreprise de défrichage de cesser ses travaux, puis j’ai informé le personnel de la Ville. Après avoir discuté avec le propriétaire foncier et l’entreprise de défrichage, l’expert-forestier municipal a conseillé à Mattamy de cesser tous les travaux d’enlèvement d’arbres jusqu’à nouvel ordre.</p>
<p>Le propriétaire foncier a indiqué qu’il n’avait pas mis à jour le rapport sur la conservation des arbres après l’analyse détaillée du nivellement, ce qui a expliqué pourquoi les trois arbres en question ont été enlevés. Le personnel de la Ville se rencontre à l’interne cette semaine pour examiner les options qui pourraient inclure des accusations en vertu du Règlement municipal sur la protection des arbres, divers modes de dédommagement liés aux arbres qui ont été perdus compte tenu des erreurs de procédure de la part du propriétaire foncier.</p>
<p>Il faudra du temps pour résoudre cette question, mais jusqu’à ce que cela soit fait, aucun autre abattage d’arbre n’aura lieu.</p>

<li>Plan de stationnement : Dans la mesure du possible, les entrepreneurs et les employés se stationneront sur le site. Le terrain est assez grand et il existe un stationnement près de la vieille maison en pierre.</li>
<li>Enlèvement des arbres : Le plan d’aménagement paysager prévoit l’enlèvement de la plupart des arbres sur la propriété. Les travaux devraient commencer à la mi-mars. Mattamy doit obtenir un permis d’enlèvement d’arbres auprès de la Ville d’Ottawa et respecter tous les règlements en vigueur.</li>

<p>The City has received an application for a Plan of Condominium and Part Lot Control for <a href="http://glengower.ca/tag/1837-maple-grove/">1837 and 1849 Maple Grove Road</a>.</p>
<p>The lands are part of Mattamy’s Maple Grove Subdivision (D07-16-21-0005), which was draft approved in January of 2022. A related Zoning By-Law Amendment was passed in July of 2022. The sites are proposed to be developed with 62 back-to-back townhome units and 28 traditional townhome units, to be accessed from two internal private roadways. 11 blocks within the proposed plan will include the townhouse dwellings and further 2 blocks will provide private roadway access off the north of the site.</p>
<p>The purpose of the Common Elements Plan of Condo application is to establish common ownership for the private roadways and all shared services and site elements. The stone cottage will be retained as a parcel of tied land within the Condominium. A concurrent Lifting of Part Lot Control will create 90 lots for the residential units.</p>

<p style="font-weight: 400;">La Ville a reçu une demande de plan de copropriété et de réglementation relative aux parties de lots de terrain pour les propriétés situées aux <a href="http://glengower.ca/tag/1837-maple-grove/">1837 et 1849, chemin Maple Grove</a> (page en anglais).</p>
<p style="font-weight: 400;">Les terrains font partie du lotissement de Mattamy du chemin Maple Grove (D07-16-21-0005) dont la version provisoire du plan a été approuvée en janvier 2022. Une demande connexe de modification du <em>Règlement de zonage</em> a été adoptée en juillet 2022. On propose d’aménager sur ces terrains 62 habitations en rangée dos-à-dos et 28 habitations en rangée traditionnelles, lesquelles seront accessibles à partir de deux voies privées intérieures. Dans le plan proposé, il y aurait 11 îlots comprenant les habitations en rangée et 2 îlots supplémentaires comprenant les voies privées donnant accès au nord du site.</p>
<p style="font-weight: 400;">La demande de plan de copropriété des parties communes vise à établir la propriété partagée des voies privées ainsi que de tous les services et éléments communs sur le site. La petite maison en pierre sera conservée comme parcelle de terrain liée au sein de la copropriété. Une suspension de la réglementation relative aux parties de lots de terrain, présentée en parallèle, permettra de créer 90 lots pour les habitations.</p>

<p>The Zoning By-Law amendment proposal from Mattamy Homes at <a href="http://glengower.ca/development/1837-1849-maple-grove/">1837 and 1849 Maple Grove Road</a> will go to Planning Committee on June 23.</p>
<p>The application would rezone the properties to permit Mattamy’s construction of 90 townhomes on four private streets with access to Maple Grove Road. The two existing heritage buildings on the site—the Patrick Hartin House and the “stone cottage”—will be retained for future commercial and residential use, respectively. You can read more about the proposal on the City’s development application site.</p>
<p>Here are the official comments I provided in the <a href="https://pub-ottawa.escribemeetings.com/filestream.ashx?DocumentId=72554">staff report</a>:</p>
<p style="padding-left: 40px;">“I am very pleased to see plans for adaptive reuse of Patrick Hartin House and the stone cottage as part of the subdivision on this site. I encourage the applicant to seek formal Part IV heritage designation for the stone buildings in the future.”</p>
<p>The City hosted a <a href="https://www.youtube.com/watch?v=UK8iXXNSWiU&amp;feature=emb_imp_woyt">virtual public meeting</a> for this proposal last spring, and our office hosted a pre-construction meeting for the adjacent community in April.</p>
<p>The Planning Committee meeting begins at 9:30 am and can be watched on <a href="https://www.youtube.com/channel/UCUR3i_hvk3-3i8vtrPg6v1Q">Council’s YouTube page</a>. If Planning Committee follows staff recommendation to approve the application, it will rise to Council for final approval on July 6, 2022.</p>

<h2 style="font-weight: 400;">Le Comité de l’urbanisme examine la proposition relative aux 1837 et 1849, chemin Maple Grove</h2>
<p style="font-weight: 400;">La proposition de modification du Règlement de zonage de Mattamy Homes relative aux <a href="http://glengower.ca/development/1837-1849-maple-grove/">1837 et 1849, chemin Maple Grove</a> sera soumise au Comité de l’urbanisme le 23 juin.</p>
<p style="font-weight: 400;">La demande vise à modifier le zonage des propriétés afin de permettre à Mattamy Homes de construire 90 maisons en rangée sur quatre rues privées reliées au chemin Maple Grove. Les deux bâtiments patrimoniaux situés sur le site, soit la maison Patrick Hartin et le « chalet en pierre » adjacent, seront conservés à des fins d’utilisation ultérieure de nature commerciale et résidentielle, respectivement. Pour obtenir de plus amples renseignements au sujet de cette proposition, consultez le site de la Ville consacré aux demandes d’aménagement.</p>
<p style="font-weight: 400;">Voici les commentaires officiels que j’ai fournis dans le <a href="https://pub-ottawa.escribemeetings.com/filestream.ashx?DocumentId=72554">rapport du personnel</a> (en anglais seulement) :</p>
<p style="font-weight: 400;">« Je suis très heureux de voir les plans de réutilisation adaptative de la maison Patrick Hartin et du chalet en pierre adjacent dans le cadre du projet de lotissement du site. J’encourage le demandeur à faire les démarches nécessaires afin que les bâtiments en pierre fassent l’objet d’une désignation patrimoniale officielle en vertu de la partie IV de la <em>Loi sur le patrimoine de l’Ontario</em>. »</p>
<p style="font-weight: 400;">Au printemps dernier, la ville a tenu une <a href="https://www.youtube.com/watch?v=UK8iXXNSWiU&amp;feature=emb_imp_woyt">réunion publique virtuelle</a> concernant cette proposition, et notre bureau a organisé une réunion préalable aux travaux à l’intention des membres de la communauté environnante en avril.</p>
<p style="font-weight: 400;">La réunion du Comité de l’urbanisme débute à 9 h 30 et peut être visionnée sur la <a href="https://www.youtube.com/channel/UCUR3i_hvk3-3i8vtrPg6v1Q">page YouTube du Conseil</a>.Si le Comité de l’urbanisme adopte la recommandation du personnel en faveur de l’approbation de la demande, celle-ci sera soumise au Conseil aux fins d’approbation finale le 6 juillet 2022.</p>

<p>The City has received a subdivision and zoning by-law amendment application from Mattamy Homes for 1837-1849 Maple Grove Road. The 1.75 hectare site is just east of Montserrat Street, on the north side of Maple Grove in the Fairwinds community.</p>

<p><strong>Plan of Subdivision</strong></p>
<p>The proposal is to develop a residential subdivision with 90 townhomes (28 three-storey townhomes and 62 three-storey, back-to-back townhomes). Four private connections to Maple Grove road are proposed for vehicle and pedestrian access. On-street visitor parking is proposed as part of the development and landscape buffers will provide additional space between the proposed streets and abutting properties.</p>
<p>There are four existing vacant structures on the site, two of which are 19th century stone buildings listed on the City of Ottawa Heritage Register. The applicant proposes to retain these two buildings: The Patrick Hartin House will be used for commercial purposes and the smaller stone cottage will be used as storage or meeting space for residents.</p>
<p><strong>Zoning by-law amendment</strong></p>
<p>The site is currently zoned &#8220;Development Reserve Subzone 1&#8221; and &#8220;General Mixed Use, Subzone 16&#8221;. The application to support the proposed development would involve rezoning to &#8220;Residential Third Density Zone&#8221;. Retaining the stone cottage requires an exemption to permit storage and a place of assembly. A site-specific exception is required to reduce the rear yard setback from 7.5 metres to 6.3 metres. An amendment is also required to expand the list of permitted uses to facilitate future commercial use for the Patrick Hartin House.</p>

<h2>1837-1849, chemin Maple Grove : Plan de lotissement et modification du Règlement de zonage</h2>
<p>La Ville a reçu une demande de modification du plan de lotissement et du Règlement de zonage de la part de Mattamy Homes pour le 1837-1849, chemin Maple Grove. Cette propriété de 1,75 hectare est située à l’est de la rue Montserrat, du côté nord du chemin Maple Grove, dans la collectivité de Fairwinds.</p>

Un des premiers cottages ontariens, à toiture métallique, véranda couverte sur toute la largeur de la façade avec aisseliers ornementaux et cheminées de pierre sur les murs pignons. Façade asymétrique. Porte principale aux fenêtres latérales en bois. Ce bâtiment est l’une des rares structures à avoir survécu au grand incendie de 1870.</p>

<p><strong>Plan de lotissement</strong></p>
<p>Le projet consiste à aménager un lotissement résidentiel de 90 habitations en rangée (28 habitations en rangée de trois étages et 62 habitations en rangée de trois étages dos à dos). Quatre liens privés vers le chemin Maple Grove sont proposés pour l’accès des véhicules et des piétons. Le stationnement sur rue est proposé pour les visiteurs dans le cadre de cet aménagement, et des zones tampons paysagères fourniront un espace supplémentaire entre les rues proposées et les propriétés adjacentes.</p>
<p>Le site compte quatre structures vacantes, dont deux sont des bâtiments en pierre du XIX<sup>e</sup> siècle inscrits au registre du patrimoine de la Ville d’Ottawa. Le promoteur entend conserver deux bâtiments, à savoir la maison Patrick Hartin, qui sera utilisée à des fins commerciales, et le cottage en pierre, plus petit, qui servira de lieu d’entreposage ou de réunion pour les résidents.</p>
<p><strong>Modification du Règlement de zonage</strong></p>
<p>Le zonage actuel de l’emplacement est « Zone d’aménagement futur, sous-zone 1 » et « Zone d’utilisation polyvalente générale, sous-zone 16 ». La demande relative à l’aménagement proposé exigerait un reclassement dans la catégorie « Zone résidentielle de densité 3 ». La conservation du cottage en pierre exige une dérogation pour que l’on puisse l’utiliser en tant que lieu d’entreposage et de réunion. Une exception propre à l’emplacement est requise pour faire passer la marge de retrait de la cour arrière de 7,5 à 6, 3 mètres. Une modification est également requise pour élargir la liste des utilisations autorisées afin de permettre une utilisation commerciale future de la maison Patrick Hartin.</p>
