<p>The City of Ottawa has received a Zoning By-law Amendment and Site Plan Control application for the property located at 4829 Abbott Street East, located on the north side of Abbott Street East and west of Terry Fox Drive in the Fernbank community.</p>
<p>The proposed planned-unit development includes five low-rise stacked apartment buildings, with 12 two-bedroom apartments in each building (60 apartments total). The existing sale centre is proposed to remain, and to be converted into a two-bedroom apartment and a rental management office for the site. The proposed development includes 328 square metres of communal amenity area, as well as 114 parking spaces in total – 87 residential spaces (including 13 garage), 15 visitor spaces and 12 office spaces. In addition, 31 outdoor bicycle parking spaces are provided and distributed in-between the five buildings. Access to the site is located on Abbott Street East, using the existing driveway servicing the sales centre.</p>

<h3>Zoning By-law Amendment</h3>
<p>The Zoning By-law provides controls for the use and type of development of all land in Ottawa, including provisions for building heights, the number of parking spaces, and the size of front, side and rear yards.</p>
<p>The site is currently zoned as R4S[2351] (Residential Fourth Density, Subzone S, Urban Exception 2351). The proposed development seeks relief from the Zoning By-law to permit the existing sales centre to be converted to a dwelling unit and an office, to permit tandem parking in a driveway leading to a garage parking space, to permit an increased size for the accessory stucture (the communal garage), and to reduce the interior side yard setback to 4.5 along the west interior lot line.</p>

<p>The site plan control process allows the City to influence land development so that it is safe, functional and orderly. It is also used to ensure that the development standards approved by the City and other agencies are implemented and maintained. Building location, landscape treatment, pedestrian access, drainage control and parking layout are a few of the items addressed during review.</p>

<h3>What’s next</h3>
<p>This application has not been approved. City staff will be reviewing the application to ensure it complies with applicable provincial policy and city policy and by-laws. Councillor Glen will also be reviewing this application with his team.</p>
<p>The Minor Zoning By-law Amendment will be considered under the City’s new Staff delegated authority for Minor Zoning By-law Amendments, and does not require committee or council approval. Councillors have the ability to remove delegated authority.</p>
<p>Note that under Bill 109 enacted by the Provincial government in 2022, City Council no longer has the final say on Site Plan Control approvals. Although Councillors can provide feedback and comments, the final decision rests with City staff.</p>

<p>La Ville d&#8217;Ottawa a reçu une demande de modification du Règlement de zonage et de réglementation du plan d&#8217;implantation pour la propriété située au 4829, rue Abbott Est, située du côté nord de la rue Abbott Est et à l&#8217;ouest de la promenade Terry-Fox dans la collectivité de Fernbank.</p>
<p>Le projet d&#8217;aménagement prévu d&#8217;unités de logement comprend cinq immeubles d&#8217;appartements superposés de faible hauteur, chacun comportant 12 appartements de deux chambres (soit un total de 60 appartements). Il est proposé de conserver le centre de vente existant et de le convertir en un appartement de deux chambres à coucher et en un bureau de gestion de la location pour l&#8217;emplacement. L&#8217;aménagement proposé comprend 328 mètres carrés d&#8217;aire d&#8217;agrément communautaire, ainsi que 114 places de stationnement au total – 87 espaces résidentiels (dont 13 garages), 15 places pour les visiteurs et 12 bureaux. <h3>Modification du Règlement de zonage</h3>
<p>L&#8217;emplacement est actuellement désigné R4S[2351] – Zone résidentielle de densité 4, sous-zone S, exception urbaine 2351. L&#8217;aménagement proposé vise à dispenser des ouvrages de se conformer au Règlement de zonage pour permettre la conversion du centre de vente existant en un logement et en bureaux, pour permettre le stationnement en tandem dans une entrée de cour menant à une place de stationnement dans un garage, pour permettre une augmentation de la taille de la structure accessoire (le garage commun) et pour réduire le retrait de la cour latérale intérieure à 4,5 le long de la ligne de lot intérieure ouest.</p>

<p>Le processus de réglementation du plan d&#8217;implantation permet à la Ville d&#8217;influer sur l&#8217;aménagement du territoire afin de veiller à ce que celui-ci soit sûr, fonctionnel et harmonieux. Il sert également à garantir l&#8217;application et le respect des normes d&#8217;aménagement approuvées par la Ville et d&#8217;autres organismes. <h3>Prochaines étapes</h3>
<p>Cette demande n&#8217;a pas été approuvée. Le personnel de la Ville l&#8217;examinera pour s&#8217;assurer qu&#8217;elle respecte les politiques applicables du gouvernement provincial, ainsi que les politiques et les règlements de la Ville. Le conseiller Glen Gower examinera également la demande avec son équipe.</p>
<p>La modification mineure du <em>Règlement de zonage</em> ne nécessite pas l’approbation du Comité ni du Conseil. Elle sera examinée par le personnel, conformément aux nouveaux pouvoirs qui lui sont délégués, à moins qu’ils ne soient révoqués par les conseillères et conseillers.</p>
<p>Veuillez noter que, conformément au projet de loi 109 adopté par le gouvernement provincial en 2022, les conseils municipaux n’ont plus le dernier mot concernant l’approbation des plans d’implantation. <p>The City of Ottawa has received a Zoning By-law Amendment application to extend the temporary site-specific zoning exception for a sales office that was approved on July 13, 2016, and subsequently extended on July 2, 2019. No change in built form or uses of the property is proposed.</p>
<p>The subject property is currently zoned Residential Fourth Density, Subzone S, Urban Exception 2351 (R4S[2351]) which permits an office, in conjunction with an office for the sale of residential units, for the period July 13, 2016 to July 13, 2019. The intent of the amendment is to extend the temporary allowance on the property to permit an office-use for a three-year period to allow Metric Homes to operate a sales and administrative office during the development of the Trailview subdivision.</p>

<h2>4829, RUE ABBOTT EST: MODIFICATION DU RÈGLEMENT DE ZONAGE</h2>
<p>La Ville d’Ottawa a reçu une demande de modification du <em>Règlement de zonage</em> afin de proroger une exception temporaire du zonage du site pour un bureau de vente : cette exception, approuvée le 13 juillet 2016, a par la suite été prorogée le 2 juillet 2019. On ne propose pas de modifier la forme bâtie ni les vocations de la propriété.</p>
<p>La propriété visée appartient actuellement à la zone résidentielle de densité 4, sous‑zone S, exception urbaine 2351 (R4S[2351]), ce qui permet d’aménager des bureaux, dont un bureau pour la vente des logements, dans la période comprise entre le 13 juillet 2016 et le 13 juillet 2019. L’objectif de cette modification consiste à proroger l’autorisation temporaire sur cette propriété afin de permettre d’aménager un bureau pour une durée de trois ans; Metric Homes pourra ainsi exploiter un bureau de vente et d’administration durant l’aménagement du lotissement Trailview.</p>
