The zoning by-law amendment proposed for 521 Brigatine Avenue and 501 Khamsin Street will head to Planning Committee on Thursday, September 9, 2021, for approval.

The current zoning allows for both detached homes and townhomes, which Mattamy intends to build (15 and 32, respectively). The zoning by-law amendment is requested to make changes to what the City calls “performance standards”—in this case, minor modifications to features such as porches, balconies, chimney boxes, eavestroughs, air conditioning units, etc.—as well as exceptions to reduce the rear yard setback by 0.8 meters for three of the 15 single lots backing onto Poole Creek and an exception to reduce the lot width by 0.1 meter for a corner single lot.

While the basic details of the project remain the same since the public meeting in February, Mattamy has made an important change to their proposal in response to feedback received from residents: previous additional amendments sought regarding building height, lot coverage, and rear-yard setbacks were withdrawn.

Another update to the plan is in the site plan, which now has a stormwater flow channel from Brigatine to the Poole Creek Corridor for 100-year flood events. To accommodate that, the lot widths for the homes backing Poole Creek have been adjusted

I’m pleased that Mattamy was responsive to resident concerns regarding the unneeded amendments for height and lot coverage. This proposal is stronger because of that change, so thank you to residents for speaking up and taking the time out of your day to attend the public meeting.

City staff support the application because it’s consistent with our policy in the Official Plan and the Kanata West Concept Plan—this is the type of development that the city expects to see in this location. I expect it will also be supported by my colleagues on Planning Committee. With the changes made by Mattamy following public consultation, I will also be supporting this application.

If approved by Planning Committee, it will rise to Council on September 22, 2021 for final approval.

Thank you to residents who attended the virtual public meeting on Thursday night for the development application at 521 Brigatine and 501 Khasmin in the Fairwinds neighbourhood. We’ve heard concerns from residents about the type of development proposed, the change in plans from Mattamy in the intervening years between development phases, general traffic and parking issues, and the specific by-law amendments requested.

Following discussions with me and residents, Mattamy has now changed their application to walk back several variances they had initially proposed for the townhomes, which included:

Increase in permitted height (remaining at 12 metres instead of 14 metres).

Elimination of the 65% maximum lot coverage.

Reduction in the minimum lot area from 137 to 81 square metres

Reduction in the interior side yard setback between townhouse blocks (the existing zoning is 1.2 metres and Mattamy is proposing 1.5 metres)

These variances weren’t actually needed for this specific development and were only requested to bring them in line with Mattamy’s other developments across the city. I’m glad they have readjusted them to better suit this project and provide more certainty to residents. (It’s also worth noting that Mattamy didn’t need to request a by-law amendment to construct townhomes—because this is already an R3 zone, townhouses can be developed “as-of-right.” Townhomes have always been permitted.)

I’ve also asked Mattamy to confirm that they’ll stick with a more traditional townhome design, rather than a contemporary look. This would match more closely with existing houses on the south side of Brigatine.

There is another issue that I understand still troubles residents: What current homeowners saw in the showroom plans doesn’t match what’s going to be developed a decade later. Mattamy’s plans for the block have changed since residents bought their homes. This isn’t the first time we’ve seen this, especially in multi-phased developments like Fairwinds, Fernbank, etc. In this case it was the type of home being built; in other cases it can be plans for future schools, parks, or commercial development.

When people buy a home in a new development, they should get clear expectations from developers before they move in. What you see in a map in the showroom is often conceptual, and plans can change. I’d like to see more resources made available for new home buyers and better training for sales staff to help address this problem.

Mattamy’s consultant said it will be at least 2024 before we’ll see families moving into the new detached homes and townhomes. In the meantime, there are still more things to follow-up on with City staff and Mattamy. You can contact our office with any questions or concerns.

Here’s a video from the public meeting held on February 4:

l’augmentation de la hauteur autorisée (reste à 12 mètres au lieu de 14 mètres);

l’abandon de la couverture des lots maximale de 65 %;

la réduction de la superficie minimale des lots de 137 à 81 mètres carrés;

The City of Ottawa has received applications for the last phase of Mattamy’s Fairwinds subdivision. The municipal addresses are 521 Brigatine Avenue and 501 Khamsin Street.

Mattamy is proposing a mix of singles and townhouses on the temporary stormwater management pond site, which will be decommissioned soon. The current zoning allows both singles and townhouses, and the new rezoning would refine certain setbacks, building heights, and lot coverage. The proposal includes an extension of Brigatine Avenue, with 15 lots for detached dwellings and blocks for 32 townhouse units. The lots for detached dwellings will be on the northerly arm of Brigatine Avenue, backing onto to Poole Creek. The townhouses will occupy the remainder of the site.

(The parcel was part of a plan of subdivision that received draft approval in 2009, but that approval has now lapsed so a new subdivision application is required.)
