<p>The Committee of Adjustment (CoA) will consider an application for a minor variance from the Zoning By-law to permit a reduced number of resident parking spaces for a proposed apartment building at 425 Culdaff Road. The subject site is located at the northeast corner of Culdaff Road and Derreen Avenue.</p>
<p>The applicant wants to construct a six-storey, 177-unit apartment building with 177 resident parking spaces, instead of the 212 spaces required under the Zoning By-law. Visitor parking will meet the Zoning By-law and does not require relief.</p>
<p>The property is the subject of a Site Plan Control application (File No. D07-12-24-0140).</p>
<p>The notice of application and the plans submitted by the applicants <a href="https://pub-ottawa.escribemeetings.com/Meeting.aspx?Id=02f34043-b7a9-4d40-97b6-a9a13ef14d18&amp;Agenda=Agenda&amp;lang=English&amp;Item=13&amp;Tab=attachments">are available here</a>. The meeting takes place on <strong>January 14, 2025 at 9:00 a.m.</strong><strong>  </strong></p>

<p style="font-weight: 400;"><strong>MISE À JOUR :</strong> Le 14 janvier, le Comité de dérogation a approuvé cette demande de dérogation mineure afin de permettre une réduction du nombre de places de stationnement résidentielles pour un immeuble d’appartements proposé (177 places, au lieu des 212 requises en vertu du <em>Règlement de zonage</em>). Cette proposition d’aménagement doit encore passer par un processus de demande de réglementation du plan d’implantation. <p style="font-weight: 400;">Le Comité de dérogation examinera une demande de dérogation mineure au<em> Règlement de zonage</em> afin de permettre un nombre réduit de places de stationnement pour les résidents pour un immeuble d’appartements proposé au 425, chemin Culdaff. Le site visé est situé à l’angle nord-est du chemin Culdaff et de l’avenue Derreen.</p>
<p style="font-weight: 400;">Le demandeur veut construire un immeuble d’appartements de six étages et de 177 unités avec 177 places de stationnement pour les résidents, au lieu des 212 places requises en vertu du <em>Règlement de zonage</em>. Le stationnement des visiteurs sera conforme au <em>Règlement de zonage</em> et ne fait pas l’objet d’une demande de dérogation.</p>
<p style="font-weight: 400;">La propriété fait également l’objet d’une demande de réglementation du plan d’implantation (dossier n<sup>o</sup> D07-12-24-0140).</p>

<h2>Le Comité de dérogation examinera la demande de dérogation applicable au 21, promenade Huntmar (7 octobre)</h2>
<p>Le Comité de dérogation étudiera une demande de dérogation mineure visant à permettre l’augmentation de la hauteur des immeubles à bâtir sur le terrain situé au 21, promenade Huntmar, juste au nord du chemin Hazeldean. Le requérant souhaite construire en deux phases deux immeubles résidentiels de six étages totalisant 332 logements locatifs sur ce bien-fonds. Il veut accroître la hauteur maximale de ces immeubles, qui passerait de 15 mètres à 20,8 mètres.</p>

<p>The owner of <strong>11 Carleton-Cathcart</strong> has applied for two minor variances to the Committee of Adjustment. The first application seeks to demolish the existing home and shed and subdivide the property into two separate parcels in order to build two detached homes, one on each parcel.</p>
<p>Once created, the two building parcels will have a lot width of 16.61m each. Since the zoning By-Law requires a minimum lot frontage of 20.0m, a second application to the committee of adjustment is required to reduce the minimum lot frontage permitted.</p>

<h2>Demandes concernant Stittsville à l’audience du 4 septembre du Comité de dérogation</h2>
<p>Le propriétaire du <strong>11, rue Carleton Cathcart</strong> a présenté deux demandes de dérogation mineure au Comité de dérogation. La première vise la démolition de la maison et de la remise, ainsi que la division de la propriété pour y construire deux maisons isolées, sur deux parcelles distinctes.</p>
<p>Ces deux parcelles auraient une largeur de 16,61 m chacune. Comme le <em>Règlement de zonage</em>exige une façade de terrain d’au moins 20,0 m, la seconde demande au Comité de dérogation a pour objet de réduire la façade en deçà du minimum permis.</p>
<p><strong>Mattamy Homes (Fairwinds)</strong> souhaite construire 47 maisons en rangée sur allée arrière le long du <strong>chemin Maple Grove</strong>, de la ruelle Galleon et de l’avenue Harmattan, conformément aux plans remis au Comité. 										<content:encoded><![CDATA[<p>The owner of C.D.S. StoreAll Ltd on Sweetnam Drive has applied to the Committee of Adjustment to subdivide its property into four separate parcels of land. The four new parcels will be located at 3, 5, 7 &amp; 9 Sweetnam Drive.</p>
<p>The application describes how the buildings currently located on the property will be redistributed over the four new parcels to provide a minimum 23.1 metre setback to the residential area located on Savage Dr. The application to the Committee of Adjustment also requests that easements/rights-of-way be granted on some of the new parcels to the benefit of the owners of other parcels for shared access.</p>

<p>Minto is building a single family home at 161 Kimpton dr. and applying for a Minor Variance from the Zoning By-law to permit a driveway to occupy 31.5 square metres of the front yard, or 60.53% of the area of the front yard, whereas the By-law requires that a driveway not exceed 50% of the area of the yard in which it is located, in this case 26 square metres.</p>

<p>The owner of 102 Sirocco is applying for a Minor Variance to permit a reduced rear yard setback on a one-storey sunroom at the back of the home. A setback is a minimum distance separation between a structure and the property line. The zoning by-law requires a setback of 25% of the lot depth but not less than 9m. The application before the committee seeks to reduce the setback to 4.42 m or 15% of the lot depth.</p>

<p>The Committee of Adjustment holds regular Public Hearings to consider the applications that fall within its mandate. The meetings are open to the public and any interested party can appear before the Committee to present their views in support of or in opposition to an application. Public Hearings are held in the Council Chambers at Ben Franklin Place, 101 Centrepointe Drive. Stittsville is part of Panel 3. The next Public Hearing takes place on March 20th.</p>

<p>Le propriétaire du 102, croissant Sirocco présentera une demande de dérogation mineure pour autoriser la réduction du retrait de cour arrière d’un solarium à un étage à l’arrière de la maison. Le retrait est la distance minimale de séparation entre une structure et la limite de la propriété. Le <em>Règlement de zonage</em>exige un retrait de 25 % de la profondeur du lot, sans qu’il soit toutefois inférieur à 9 m. La demande soumise au Comité vise à faire passer le retrait à 4,42 m, soit 15 %.</p>

<h2>About the Committee of Adjustment</h2>
<p>The Committee of Adjustment is a quasi-judicial tribunal appointed by City Council and is independent and autonomous from the City Administration. The committee consists of fifteen members, who are divided into three panels of five members each, and each panel hears applications for a different geographic area of the city. Stittsville is part of Panel 3.  Each panel meets approximately once per month and meetings are open to the public.</p>

<p>The committee derives its jurisdiction from the <em>Planning Act </em>of Ontario and its mandate is to:</p>

<li>Consider and make decisions on applications for Consent to “sever” a property, or for any agreement, mortgage or lease that extends for more than 21 years</li>
<li>Consider and make decisions on applications for Permission, which deal with the enlargement or extension of a building or structure that is legally non-conforming, or a change in non-conforming use</li>
<li>Consider and make decisions on applications for Validation of Title and Power of Sale</li>
</ul>
<p>The Committee of Adjustment and its application processes are separate and distinct from other municipal development approval processes, and one or more of these processes may occur at the same time.</p>

<h2>Le mandat et la structure du Comité de dérogation</h2>
<p>Le Comité de dérogation est un tribunal quasi judiciaire nommé par le Conseil municipal et qui exerce ses activités indépendamment de l’administration municipale. Le Comité est composé de quinze membres, répartis dans trois groupes de cinq membres chacun, et chacun de ces groupes entend les demandes d’un secteur géographique différent de la ville.</p>

<p>Le Comité de dérogation et son processus d’examen des demandes sont distincts et indépendants des autres processus municipaux d’approbation des projets d’aménagement. Il peut donc arriver que les différents processus d’approbation se déroulent simultanément.</p>
